DIRECTIONS

Proceed along the A379 towards Kingsbridge and then turn right at Harraton Cross towards Bigbury (the B3392). Upon reaching St Ann’s Chapel, turn left at St Ann’s Chapel junction opposite The Old Chapel Inn towards Easton. After approximately 0.4 miles turn left proceeding down this road for approximately 0.7 miles whereby the entrance gate to the land will be found on the left-hand side.

SITUATION

The land is situated between the villages of Bigbury and Aveton Gifford in the South Hams area of South Devon. The nearest town of Kingsbridge is about 5 miles away and Bigbury-on-Sea approximately 4 miles away. The A38 dual carriageway expressway, connecting to the M5 motorway and national road network, being approximately 9 miles to the north with access via Wrangaton Cross.

DESCRIPTION

The land and woodland at Dukes Mill extends to approximately 11.4 acres (4.61 hectares) of attractive woodland/ amenity land. The land has been used as a wildlife and conservation habitat. The current owner has planted approximately 2,700 deciduous trees in 1993. Species of which include oak, wild cherry, rowan hall, ash and beech trees. The land and woodland at Dukes Mill has been established as a County Wildlife Site. The whole site was assessed in 2021 by the Devon Biodiversity records centre for the habitats present. The land is on a steep southeast facing slope and the current owner has cut rides into the land to enable access up the slope. This land is particularly suited to a number of purposes to include conservation/ wildlife conservation, livestock grazing and/or general recreation use.

Note: The seller is retaining the section of land located on the eastern side of the land offered for sale. The boundary between the two plots of land is marked with small orange flags on the ground for reference.

ACCESS

Access to this land is gained through the existing gateway located on the southern boundary of the land, off the council-maintained highway. This access will be shared with the current owner and there will be a right of way reserved to enable access into the retained land on the eastern boundary (see conditions listed below).

The land is sold subject to the following conditions (further details of these conditions are available in the legal pack): -

1. Seller to supply, erect and maintain thereafter a post and rail boundary fence (without wire attached) within 8 weeks following legal completion.

2. The Buyer is permitted to erect their own stockproof or electric fences on the slope in the event that livestock are to be kept on the land available for sale to safeguard the boundaries. This fence that might be erected by the Buyer will belong to the Buyer, whereas the fence erected in number 1 above will belong to the Seller.

3. The Seller reserves a right of way (for all purposes at all times) through the existing gateway (located on the southern boundary) and over the land being offered for sale to get to the retained land for the purposes of annual cutting of vegetation.

4. No unnecessary felling of trees to be carried out on the land being offered for sale, except where trees are causing danger, suffering from disease or require thinning.

5. No spraying with pesticides or toxic substances.

6. No solar panels, wind turbines or polytunnels.

TENURE

The property is being offered for sale on a freehold basis with vacant possession on legal completion.

SERVICES

There are currently no mains services connected to the land. There is believed to be mains water in the adjoining council-maintained road and buyers are required to make their own enquiries of South West Water in relation to this.

RIGHTS OF WAY

There are no public footpaths or rights of way over the land as far as known.

All sporting and mineral rights are included in the sale, as far as known.

ENVIRONMENTAL STEWARSHIP

The land is not subject to any Environmental or Countryside Stewardship Scheme agreements.

The land is sold subject to any Wayleave and Easement Agreements.

METHOD OF SALE

The land is being offered for sale by Formal Tender (unless sold prior), with a closing date of Tuesday 29th October 2024 at 12 noon.

Tenders must be submitted to 62 Fore Street, Kingsbridge, TQ7 1PP in an envelope clearly marked 'Land & Woodland at Dukes Mill’.

Buyers who wish to submit a tender will be required to sign a legal contract, available from the solicitor acting for the seller (see Legal Pack below) and provide a deposit of 10% of their offer price, as their tender. If either of these two component parts are not submitted, their tender risks being declined.

The successful purchaser will be liable to pay the sum of £1,500 plus VAT as an administration fee to Luscombe Maye in addition to their tender.

A tender which is accepted by the seller will be treated as a binding contract and immediately constitute an exchange of contracts. Legal completion and payment of the balance of the purchase price will follow approximately 28 days later, or in the time frame as set out in the legal pack.

The seller does not undertake to accept the highest or any of the offers and the seller reserves the right to withdraw, alter or amend the way in which the land is offered for sale.
